  • Be at least 18 years of age or have verified parental consent if under 18, in accordance with the Digital Personal Data Protection Act, 2023 ("DPDP Act").
  • Have the legal capacity to enter into a binding agreement under the Indian Contract Act, 1872.

  • Respect the intellectual property rights of UltraCorr IT and third parties, including copyrights, trademarks, and trade secrets.

5. Intellectual Property

6. Payment and Fees

Certain Services may require payment of fees, which will be communicated to you in advance through a service agreement or on our website. All payments must be made in Indian Rupees (INR) unless otherwise specified, and in accordance with the terms outlined in the relevant agreement.

  • Pay all applicable fees and taxes as per the Payment and Settlement Systems Act, 2007, and other applicable laws.
  • Provide accurate billing information and promptly update any changes.

Non-payment or delayed payment may result in suspension or termination of Services, subject to the Consumer Protection Act, 2019. Refunds, if applicable, will be processed in accordance with our refund policy or as required by law.

7. Termination

We reserve the right to terminate or suspend your access to the Services, with or without notice, for reasons including but not limited to:

  • Violation of these Terms.
  • Non-payment of fees.
  • Conduct that we believe harms UltraCorr IT, its users, or third parties.

You may terminate your use of the Services at any time by discontinuing access or notifying us via email at info@ultracorrit.com. Upon termination, your rights to access the Services will cease, but any obligations (e.g., payment or confidentiality) that by their nature survive termination will remain in effect.

8. Limitation of Liability

To the fullest extent permitted by Indian law, including the Consumer Protection Act, 2019, UltraCorr IT shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services. Our total liability for any claim arising from these Terms or the Services shall not exceed the amount paid by you for the Services in the preceding 12 months.

We do not guarantee that the Services will be uninterrupted, error-free, or free from viruses or other harmful components. You use the Services at your own risk, subject to applicable consumer protection laws.

9. Indemnification

You agree to indemnify and hold harmless UltraCorr IT, its affiliates, officers, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights, including intellectual property rights, in accordance with the Indian Contract Act, 1872.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

In compliance with the Consumer Protection Act, 2019, we encourage resolving disputes amicably through our Grievance Officer (details in Section 11). If the dispute remains unresolved, either party may pursue legal remedies, including arbitration as per the Arbitration and Conciliation Act, 1996, if agreed upon in a separate service contract.

13. Miscellaneous

  • Severability: If any provision of these Terms is found to be invalid or unenforceable under Indian law, the remaining provisions will continue in full force and effect.
  • Entire Agreement: These Terms, along with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and UltraCorr IT regarding the Services.
  • Force Majeure: We shall not be liable for delays or failures in performance due to events beyond our reasonable control, such as natural disasters or government restrictions.
  • No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
